ARTICLE 1 - LEGAL INFORMATION
These Terms and Conditions of Sale (hereinafter "TCS") are provided by Nidota SAS, registered with the R.C.S. of Paris under number 934 854 58.

ARTICLE 2 - PURPOSE OF THE TCS
These TCS define the rights and obligations of the parties regarding the online sale of products offered by Nidota via the website www.nidota.com. They apply to any order placed on the site, in accordance with Articles L.111-1 and following of the French Consumer Code.
ARTICLE 3 - PRODUCTS
The products sold by Nidota include baby accessories such as stroller bags, maternity bags, toiletry bags, pacifier holders, lunch bags, pouches, and changing mats.
Each product is described in detail on the website, in accordance with Article L.111-1 of the French Consumer Code. The photographs are non-contractual but accurately reflect the products.
ARTICLE 4 - PRICES
Prices are displayed in euros, including all taxes (VAT included), excluding shipping costs, in accordance with Article L.112-1 of the French Consumer Code. Nidota reserves the right to modify prices at any time, but products will be invoiced based on the rates in effect at the time the order is confirmed.
ARTICLE 5 - ORDER PROCESS
Customers place orders online by adding items to their cart and confirming their payment. Any validated order implies full and unconditional acceptance of these TCS, in accordance with Article L.221-14 of the French Consumer Code.
ARTICLE 6 - PAYMENT
Purchases must be paid for by credit card, PayPal, or any other payment method available on the website. Payments are secured in accordance with current standards (DSP2 and GDPR).
In case of non-payment or dispute, Nidota reserves the right to cancel the order.
ARTICLE 7 - DELIVERY
The online sales offers presented on the site are reserved for consumers residing in France or DROM-COM, or, where applicable, in a member country of the European Union, and for deliveries in these same geographical areas.
Delivery means the transfer to the Customer of physical possession or control of the Product.
Shipping costs are those specified when finalizing the order and are accepted upon validation of the order.
Indicative delivery times are announced in working days on the Site when ordering. They may vary depending on the delivery method chosen and the location of destination.
However, if one or more Products cannot be delivered within the time initially announced, the Company will send an email informing the Customer of the new delivery date.
The Products will be delivered to the address indicated by the Customer when ordering. It is therefore up to him to check that this address does not contain any errors. The Company cannot be held liable if the address provided by the Customer is incorrect, thus preventing or delaying delivery.
Upon delivery, it is the Customer's responsibility to check that the Products delivered comply with their order and that the package is sealed and undamaged. If this is not the case, the Customer must indicate this on the delivery slip. No complaint about the quantity or condition of the Product will be accepted if the complaint has not been included on the delivery slip.
ARTICLE 8 - RIGHT OF WITHDRAWAL
In accordance with Articles L.221-18 and following of the French Consumer Code, customers have 14 days from receipt of their order to exercise their right of withdrawal without having to provide a reason.
Products must be returned in perfect condition and in their original packaging. Return costs are borne by the customer unless the product is defective.
ARTICLE 9 - WARRANTIES AND LIABILITY
Products are covered by:

The legal guarantee of conformity (Articles L.217-4 to L.217-14 of the French Consumer Code), valid for 2 years from delivery.
- The warranty against hidden defects (Articles 1641 to 1649 of the French Civil Code).
Nidota shall not be held liable for damages resulting from improper use of the product.
ARTICLE 10 - INTELLECTUAL PROPERTY
All elements of the website are the exclusive property of Nidota. Any total or partial reproduction is prohibited without prior authorization, in accordance with the French Intellectual Property Code.
ARTICLE 11 - PERSONAL DATA
Nidota is committed to protecting customers' personal data in accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act (Law No. 78-17 of January 6, 1978).
Customers have the right to access, rectify, and delete their data by contacting Nidota via email.
ARTICLE 12 - COMPLAINTS AND MEDIATION
In case of a dispute, complaints can be sent to Nidota’s customer service at hola@nidota.com.
In accordance with Article L.612-1 of the French Consumer Code, customers may also refer unresolved disputes to a consumer mediator free of charge.
ARTICLE 13 - DISPUTE RESOLUTION
In the event of a dispute, an amicable solution will be sought before any legal action. If no agreement is reached, the competent court will be that of Nidota's registered office, in accordance with Article 46 of the French Code of Civil Procedure.
These TCS may be updated periodically. The applicable version is the one published on the website at the time of the order.
